Since July 26, 2023, the list of allergens has evolved and fifty new substances have been added to the 24 previously listed in Annex III of the European Cosmetic Regulation No 1223/2009 - No. 89. These additions were decided following the advice of the Scientific Committee for Consumer Safety or SCCS. What are the newly listed allergens? What does the new legislation say? Discover everything there is to know about cosmetic regulation in terms of allergens.

Cosmetology: What is an Allergen?
An allergen, which can be of natural or synthetic origin, is a substance foreign to the body that can trigger a hyperactive response from the immune system. In cosmetics, allergens are primarily fragrances and essential oils incorporated into the formulation. The allergenic nature of a substance comes from its ability to bind to proteins present in the skin, which results in the production of antibodies. To avoid allergic reactions in consumers, the dosage of allergenic substances must be quantified. Therefore, every cosmetic manufacturer is obligated to disclose their presence on the product labeling.
A closer look at the new cosmetic regulation concerning allergens.
On July 26, 2023, the European Commission published Regulation No 1545/2023, amending the historic Regulation No 1223/2009 of the European Parliament and Council regarding the labeling of allergenic fragrance substances in cosmetic products. New allergens have been added to the list, with the aim of protecting consumers. According to the latest estimates, the percentage of the population allergic to fragrance substances in the European Union is approximately 1 to 9%. Furthermore, an increase in the prevalence of eczema in the population has been observed in recent years, justifying the implementation of new protective measures.
What are the rules regarding allergens?
The dosage and labeling of allergens are strictly regulated by the European Commission. Indeed, there are thresholds that must not be exceeded regarding the concentration of allergenic substances in a skincare product. These thresholds depend on each allergen, the type of product, and the level of exposure. They are defined by the IFRA (International Fragrance Association), an international association whose mission is to promote safer use of fragrances. Moreover, it is mandatory to mention allergens in the INCI list of cosmetic products if their concentration exceeds 0.01% in rinse-off products and 0.001% in leave-on products.
When will this new regulation take effect?
We will have to wait until July 31, 2026 for the new allergen regulation to take effect. The new cosmetics that will be introduced to the market from this date will have to comply with the new legislation, and this will apply to both European companies and those introducing their product for the first time in the European Union market.
After which, the July 31, 2028, these provisions will become applicable to the products already offered for distribution. Manufacturers will then have three to five years to withdraw from the market any cosmetic products that do not comply with the new labeling provisions.
